§ 1 Scope and provider

These Terms and Conditions apply to all contracts for the purchase of a license for the software “Hush” concluded via this website between Martin Kistner, Lorscher Straße 5, 60489 Frankfurt am Main, Germany (“Provider”) and you as customer. The Provider is a small business under § 19 of the German VAT Act (UStG).

§ 2 Subject matter

The subject of the contract is the grant of a license to use the Hush software for macOS. The scope of features is determined by the product description on this website at the time of purchase. The free trial does not create any payment obligation and may be ended at any time without a license.

§ 3 Conclusion of contract

The presentation of products on the website does not constitute a binding offer. By clicking “Buy license” and completing payment through our payment provider Stripe, you submit a binding offer to purchase the selected license. The contract is concluded upon confirmation of payment or delivery of the license key.

§ 4 Prices and payment

The prices shown on the website at the time of order apply. These are final prices. Due to the small-business rule under § 19 UStG, no VAT is calculated or shown. Payment is made via the payment methods offered by Stripe.

§ 5 Delivery of the license key

After successful payment, the license key is sent to the e-mail address you provide during checkout. You are responsible for providing a correct and reachable e-mail address. Recovery of the key is only possible via this e-mail address.

§ 6 Usage rights / license

Upon full payment, you receive a simple, non-exclusive right to use Hush permanently (lifetime license). The license does not expire and does not need to be renewed. The license may be activated on your own Macs. Transfer, resale, or publication of the license key to third parties is not permitted.

§ 7 Updates and support

With your lifetime license, you receive access to updates and improvements we provide for Hush. We continue to develop the app and address bug fixes and compatibility adjustments where reasonable for us. Beyond statutory warranty, there is — as is customary for software — no entitlement to specific updates, new features, or permanent support for future macOS versions.

For questions or issues, you can reach us by e-mail. We respond personally and as promptly as possible. No fixed response time or support beyond legal requirements is owed.

If development of Hush is discontinued at some point, you retain your license and may continue using the last available version. Your acquired right of use does not expire as a result.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. Details — in particular regarding the early expiry of the right of withdrawal for digital content — can be found in our Right of Withdrawal notice.

§ 9 Warranty and liability

Statutory warranty rights apply. The Provider is fully liable for intent and gross negligence as well as for injury to life, body, or health. In cases of simple negligence, the Provider is liable only for breach of an essential contractual obligation and only for the typical, foreseeable damage. Otherwise, liability is excluded.

§ 10 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their habitual residence. If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.
